BY PRESIDENT THIRU. K.JAYABALAN B.Sc., B.L.,
This complaint is filed by the complainant u/s 12 of the Consumer Protection Act.1986.
The Complainant filed this Complaint as party in person and the same was taken of file on 14.06.2016 and the first hearing posted to 15.07.2016.
On the first hearing the Opposite Parties 1 & 2 did not appear and hence fresh notice to them was ordered privately and adjourned to 12.08.2016. There after several hearings adjourned to send notice to the Opposite Parties privately by the Complainant. However the Complainant did not take any steps on none of the hearings and also he did not appear for any hearing. Finally on 30.3.2017 hearing the case adjourned to 26.4.2017 hearing and from 26.4.2017 adjourned to 24.5.2017 (today) directing the Complainant to send fresh notice to the Opposite Parties as last chance failing to take steps the Complaint will be dismissed.
Even after such ultimatum, the Complainant has not chosen to appear before this forum and to take steps by sending fresh notice to the Opposite Parties. The above attitude of the Complainant failed to take steps leads to an irresistible conclusion that the Complainant has no interest in prosecuting the Complaint and hence the Complaint is liable to be dismissed.
In the result, the Complaint is dismissed for non prosecution.
Pronounced by us on this 24th day of May 2017.
