R.K.BISHNOI, JUDICIAL MEMBER:

          During course of arguments, it has come to our notice that parties did not produce any evidence before the District forum  reference of which has been given in the impugned order.  Complaint was adjourned time and again for documents to be filed by the parties and arguments, but, there is no statement of any counsel or party about tendering any document in evidence. Latest order about tendering documents and arguments is dated 14.10.2013 which is reproduced as under:-

                    “Present:- Counsel for the parties.

Documents not filed. Date is requested.    Given.  Now, to come upon 16.12.2013 for filing documents, if any and arguments.”

  On 16.12.2013 no document was tendered and complaint was straightway adjourned for arguments.  For ready reference the said order is reproduced as under:-

Thereafter the complaint was adjourned time and again for arguments only and not the evidence. When complainant did not produce any evidence and there was no opportunity for the OP to produce any evidence in rebuttal. In these circumstances impugned order dated 30.03.2016 is set aside. The matter is remitted back to the District Forum, Kurukshetra to afford an opportunity to the parties to lead evidence and thereafter decide the matter afresh.

Parties are directed to appear before District forum, Kurukshetra on 03.01.2017.
