Order no. 3       dt. 12.10.09

Today is fixed for admission hearing. We have heard the ld lawyer for the complt at length. We have also perused the petition of complaint and the annexures. The main and specific allegation of the complt is against issuing a fabricated cheque by the op demanding Rs. 30,000/- of money to be paid by the complt. We failed to understand that what debarred the complt. to file any criminal case agains the op for issuing such fabricated cheque. He has not taken any criminal step against the op and nor even he has informed the police against such unlawfull criminal activity against the op.

This being the position, we are not inclined to pass any favourable order admitting the case. Having due regard to the circumstances, the case stands rejected with liberty to file criminal case in the appropriate forum.
