The case of the complainant in short is that complainant is a consumer under the o.p. regarding credit card no.4166 4415 0000 4336. Due to ill health and some family problem complainant could not make payment to the bank in time and as such he is liable to pay some dues to o.p. O.p. however started sending muscle man, the person with questionable character to create pressure and given threat to the complainant for collecting the said dues. Complainant requested the o.ps. not to adopt such illegal acts but they did not pay heed to such request and did not consider the prestige and status of the family of the complainant. On 12.9.13 the persons came to the residence of complainant and threatened with dire consequences and as such complainant informed the matter to the local police station and also issued legal notice to the bank informing the said incident. Hence, the case was filed by the complainant with the prayers contained in the prayer portion of the petition of complaint.
O.ps. did not contest the case by filing w/v and as such, matter was heard ex parte against the o.ps.
Decision with reasons:
We have gone through the evidence of the complainant and documents in particular and we find that Due to ill health and some family problem complainant could not make payment to the bank in time and as such he is liable to pay some dues to o.p. Complainant never denied to make payment of the said dues but complainant prayed some times to clear off the dues to o.p.
Considering the above position and on careful scrutiny of the entire materials on record, we find that complainant has failed to substantiate his case by filing cogent evidence and documents to that effect and as such, complainant is not entitled to relief.
Hence, ordered,
That the case is dismissed ex parte against all the o.ps. without cost.
Supply certified copy of this order to the parties free of cost.
