Ld. advocate for the complainant appears and submits his case.

Upon considering his submission and on perusal of the entire materials on record, it is crystal clear that the complainant cannot be termed as “Complainant” in the light of the definition of consumer as laid down in the Consumer Protection Act, 1986 since the consumer is a businessman as stated in the very first time of the petition of complainant but there is no whisper in the petition that he runs the business for his livelihood and or for the members of his family.

In view of the above, the instant petition is rejected.

Complainant is at liberty to agitate the issue on the selfsame cause of action before the appropriate Forum.
