File taken up on today on the application moved by counsel for the DH with a request to give permission to withdraw the present execution petition.
DH made a separate statement to the effect that she has compromised the matter with the JD, as such, the JD replaced the defective LED with new one alongwith warranty certificate. Due to compromise, she does not want to claim the compensation and litigation expenses amounting Rs.5000/- from the JD. She further stated that she does not want to proceed further with the present execution petition and wants to withdraw the same being fully satisfied.
Heard. Keeping in view the above-mentioned statement suffered by the DH, present execution petition is hereby dismissed as withdrawn, being fully satisfied. Copy of this order be supplied to the parties, free of costs, as per rules. File be consigned to the records, after due compliance.
