Brief facts
The case of the complainant is that the opposite party is not delivering the gas to his house. So that the complainant was forced to collect the cyllinder from near by shop. The complainant made complaints before the Manager of opposite party No.1, the taluk supply officer, and Dist. Collector etc. When he made a complaint to the Taluk Supply officer, Kondotty, he directed the opposite party to supply the gas and the complainant got the cyllinder. But thereafter the same thing was happened and now the opposite party is collecting additional amount from the customers by delivering the cyllinders from near by shops and he was even not ready for issuing the bill for the same. Hence because of all the above reasons , he filed this complaint.
Opposite party set exparte. The complainant filed affidavit and Ext. A1 to A5 are marked. Ext. A1 is the copy of the gas book, Ext. A 2is the complaint made by the complainant before Taluk supply officer, Kondotty, Ext. A3 is the complaint made by the complainant before Dist Collector, Malappuram Ext. A4 is the letter issued by Dist collector, Malappuram dated 30/6/2016 infavour of the complainant and Ext. A5 is the proceedings issued by Dist. Collector, Malappuram dated 1/8/14.
Heard the complaint, perused the records. According to the complainant, the distance between the opposite party No.1 agency and his home are only 4 km. As per Ext. A5 there is a specific order for the distributor that up to 5 km, it will be free zone area. Hence by accepting additional charge and not delivering the cylinder with in 4 kms the opposite parties had committed clear deficiency in service. Hence we are passing the following orders. More over, there is no contra evidence also.
The opposite party shall regularly deliver the cylinders to the the complainant at his house after receipt of the copy of this order.
The opposite party shall pay Rs.5000/- as compensation for the mental agony suffered by the complainant and Rs.2500/- as cost of the proceedings.
