O R D E R

 

NAWAB SINGH J, (ORAL)

 

          Jatiana Tours and Travels-opposite party No.1 is in appeal against the order dated October 21st, 2015 passed by District Consumer Disputes Redressal Forum, Karnal (for short, ‘District Forum’) whereby complaint filed by Komal Sharma and Dharambir-complainants was allowed.  Operative part of the order is reproduced as under:-

          “12.   As a sequel to the foregoing discussion, we accept the present complaint and direct the opposite parties to make the payment of 400 US Dollar to each of the complainant for loss of their luggage. The complainants shall also be entitled for a sum of Rs.20,000/- each as compensation for the mental harassment and agony faced by them and a sum of Rs.2200/- as litigation expenses.  The opposite parties shall make the compliance of this order within a period of thirty days from the date of receipt of the copy of this order.”

 

2.      Dharambir-complainant No.2 on his behalf and on behalf of his cousin Komal Sharma-complainant No.1 has stated that they have already received the amount of 400 USD from opposite party No.2. So, they do not claim anything from the appellant. 

3.      In view of this, the order passed by the District Forum has been complied with and no further order is required to be passed.  The appeal is disposed of accordingly.

4.      The statutory amount of Rs.25,000/- deposited at the time of filing the appeal be refunded to the appellant against proper receipt and identification in accordance with rules, after the expiry of period of appeal/revision, if any.
