JUDGMENT

1. The present complaint has been filed by the complainant before this commission for  the following reliefs-

1. The Op be directed to pay  Rs.28000/ the cost of the table.
2. The Op be directed to pay compensation for harassment Rs.10000/.
3.  The Op be directed to pay cost of the case Rs.5000/.

2.  The Complainant has stated that he had purchased a dinning table, steel frame for Rs. 28000/ on 27.12.2019 with a grantee /warranty of not having effect of rust for 5 years but the dinning table got started rusting after only four months. Complainant made a complainant to the OP who promised to replace the table but the table was not replaced despite of visiting a number of times at the showroom of the OP. The OP deficiency in rendering service and cause mental and physical damages to the complainant.
3.  Op did not contest the case despite of sufficient Service.
4.  Complainant has filed his affidavit and papers in support of his pleadings.
5. We have perused the material available on record and heard the complainant’s counsel.
6. Complainant has proved his case on the basis affidavit furnished by him which is an unrebutted documents and his believe to prove the case.
7.  We hereby direct to op to pay the complainant Rs 28000/ with pendente lite and future interest at the rate 8% per annum, compensation for harassment at Rs.10000/ and litigation expenses Rs.2000/.
8.  OP shall comply with the direction within a month failing which OP shall be prosecuted for non-compliance in accordance with section 72 of the Act for awarding punishment against him.
9. A copy of this judgment be provided to all the parties as per rule as mandated by Consumer Protection Act, 2019. The judgment be uploaded forthwith on the website of the commission for the perusal of the parties.
10. File be consigned to record room along with a copy of this judgment.
