The complainant has filed present complaint against O.P under section 12 of the Consumer Protection Act, 1986.  The brief facts as alleged in the complaint are that complainant had purchased a LCD make Sharp Model No.40 M for a sum of Rs.43,500/- vide bill No.5497, Book No.55 dated 26.05.2012 from OP-1.  It is further alleged that a warranty of 3 years was also given by the O.Ps.  It is alleged that in the complaint that on 03.04.2015 the said LCD T.V showed defects.  On complaint the same was rectified.  The complainant complains about having sold a defective LCD T.V and delayed action on the part of the O.Ps and hence claiming compensation.

2.     On 04.01.2016 during the course of proceedings on enquiry it was revealed by the complainant that the said T.V set is working properly and is under use by him.  He is only seeking compensation on account of mental agony and litigation.

3.     We have considered pleadings of the complaint and find that the complainant has not been able to prove that a defective T.V was sold to him.  Also the T.V is working properly and is in use by the complainant.  Therefore, we are of the view that ends of justice will be met if a sum of Rs.2,000/- as compensation towards mental agony which will also include cost of litigation is awarded to the complainant.  Ordered accordingly.

        Copy of this order be sent to the parties as per rules.
