          Appellant insurance company inspite of service did not appear before the State Commission.  No Written Statement was filed.  The defence taken by the appellant that the complaint was lodged after  16 months had not been taken before the State Commission, as a result of which the same has not been discussed by the State Commission in its order.  Even before us, counsel for the appellant has not moved an application for filing the Written Statement.  Since

the appellant did not appear before the State Commission to raise the defence, the plea that the complaint was lodged with the appellant after 16 months of the incident, cannot be taken into consideration.  Dismissed.  No costs.
