We have perused letter dated 23-12-1999 though on said letter there is no mention of section 45 QA of RBI Act, we are of opinion that said letter clearly shows participation of the Complainant before Company Law Board and we have also observed that the Complainant there after accepted part payment of the deposits in the year 2000. Acts of the Complainant shows his participation before Company Law Board, therefore, we are of the view that present Complainant is not maintainable under Consumer Protection Act as per guidelines/decisions given in Lloyds Finance Ltd. v/s Napeena Singh (supra).Complaint dismissed with no orders to costs.
