O R D E R

By filing the present appeal, Ambika Enterprises, Panchkula-opposite party No.1 has challenged the order dated August 13th, 2015 passed by District Consumer Disputes Redressal Forum, Panchkula (for short, ‘District Forum’) whereby complaint filed by Kiran Bala-complainant was allowed. For ready reference, operative part of the order is reproduced as under:-
“(i) To replace the mobile phone with new one with same model with a warranty of one year to the complainant or to refund the amount of Rs.6200/- alongwith interest @ 9% from the date of purchase till realization.
(ii) To pay an amount of Rs.5000/- as compensation for mental agony, harassment.
(iii) To pay an amount of Rs.2,000/- as cost of litigation.”
2. During the pendency of the appeal, complainant has stated that she has received the entire amount from the opposite parties awarded by the District Forum. She would withdraw the execution application before the District Forum on the next date of hearing.
3. In face of it, learned counsel for the appellant has stated that the present appeal be dismissed as withdrawn.
4. It is ordered accordingly.
5. The statutory amount of Rs.6600/- deposited at the time of filing the appeal be refunded to the appellant against proper receipt and identification in accordance with rules, after the expiry of period of appeal/revision, if any.
