ORDER NO. 6

Ld. Advocate for the Appellants is present.  Mr. S.S.Chowdhury, Ld. Advocate, appears on behalf of the Respondent No. 1 and undertakes to file Vokalatnama on the next occasion.  The Misc. Application bearing No. MA/438/2017 is taken up for hearing.  By this application the Appellant has prayed for substitution of the legal heirs of the deceased Respondent No. 3, Amarendra Sahoo.  Having heard the Ld. Advocate for the Appellant and on perusal of the papers on records we allow the Misc. Application.  Let the names of the legal heirs of the deceased Respondent No. 3 as mentioned in the schedule of the Misc. Application be incorporated in place of the Respondent No. 2 in the cause title of the Memo of Appeal.  Bench Clerk is directed to do the needful.  The Appellants are directed to file amended version of the Memo of Appeal on the next occasion.  The Misc. Application is thus disposed of.

On the prayer of the Ld. Advocate the Appellants are given liberty to serve notices along with the amended version of the Memo of Appeal upon the substituted Respondents by Speed Post with A/D fixing 18.8.2017 for filing affidavit of service.
