CC No.187 of 2020.

M/s Shiv Metal Versus Khanna Hyundai.

 

Present:    Complainant in person with Smt. Anjana Chaudhary, Advocate.

                 Shri Rajiv Kumar Gupta, Adv. for the respondent No.2.

                                                                            

               On the basis of even dated application filed by the complainant as well as respondent No.2, file taken up on today. Complainant and respondent No.2 have entered into compromise and as per compromise, respondent No.2 agreed to make total payment of Rs.1,10,000/- to the complainant as full and final settlement of the matter. Counsel for the complainant further suffered statement, according to which, complainant settled the matter with the respondent No.2 and he is agreed to repair the vehicle in question, therefore, complainant withdraws the complaint against the respondent No.2.

              In view of statement of the complainant and counsel for the respondent No.2, without making any adverse comment on the act and conduct of the respondent No.2, the present complaint as a matter of amicable settlement, is partly, accepted against the respondent No.2. The respondent No.2 is hereby ordered to make the payment of total amount of Rs.1,10,000/- (Rupees one lac ten thousand only) as mentioned hereinbefore, within the period of 50 days from today, to the complainant, in default of it, respondent No.2 shall be liable to pay interest @7% per annum simple to the complainant on the amount of Rs.1,10,000/- from the date of order till actual realization. File be consigned to records.
