This complaint has been filed by the complainant against the opposite parties seeking<br /> direction against the opposite parties for replacement of the tractor alleged to be defective or return of the price alongwith compensation on account of physical harassment and financial loss. <br /> <br /> The opposite parties appeared. Filed written statement contesting the complaint of<br /> the complainant. After conclusion of the evidence by the opposite parties to this case, we have heard counsel for the parties and have gone through the file. After going through the file we find that<br /> there is no major defects in the tractor in question except the tank<br /> unit to be replaced. It is relevant to mention here that dealer<br /> opposite party No.1 has not appeared to contest the claim of the<br /> complainant as having been proceeded ex-parte. Only functionaries of<br /> Eicher Tractor opposite parties No. 2 and 3 appeared. Therefore,<br /> under th peculiar circumstances of the case, direction is issued to<br /> opposite party No.1 to replace the tank unit, within fortnight period<br /> at its workshop at Banga Motors Phagwara Road, Banga. The complainant<br /> is also directed to produce the tractor in question in the Banga<br /> Motors, Phagwara Road, Banga within a week from the receipt of copy<br /> of order.
