Complaint filed by the respondents for recovery of the loss suffered due to storm was allowed by a two-Member Bench of the District Forum.  Petitioner, being aggrieved, filed appeal before the State Commission taking the preliminary objection that the case had been heard by a Bench which was not properly constituted.  The State Commission, by the impugned order, overruled the objection and listed the case for 7.12.2010 for being heard on merits on admission.

          We agree with the view taken by the State Commission.  Petitioner would be well advised to argue the case on merits before the State Commission.  Dismissed.
