HON’BLE JUSTICE SRI A. CHAKRABARTI, PRESIDENT.

 

Heard Mr. Pradyot Kr. Mondal, the Ld. Advocate for the Revisional Applicant.  This is a revisional application whereby order dated 31.10.2008 was challenged and the Ld. Advocate for the Revisional Application contends that maintainability petition filed by his client before the Forum below should be heard first.  From the impugned order as also the order dated 26.08.2008 it appears that it was earlier decided by the Forum below that the maintainability point was decided to be taken up at the time of trial.  In such circumstances when the said order dated 26.08.2008 was not challenged, there is no ground for challenging the order dated 31.10.2008.  In any event the proceeding appears to be is very old one and the Forum below is requested to dispose of the same at the earliest preferably within a period of six months.
