Complainant availed water connection in the year 2010 in the Consumer No. NAT/1079/N for the purpose of running a medical store. Since the connection remained out of order he maintained tube well, for the purpose. Therefore in the year 2012 itself the officers of the opposite parties removed water meter and apparatus from the premises. Thereafter opposite parties issued an arrear bill for Rs.2,000/- dtd.16/11/19. The above facts were stated to the officers and they informed to consider the same in the Adalath. But on July 2020 they issued bill for Rs.16,949/- including by monthly water charge Rs.800/-. The bills are illegal. On 06/01/21 a further notice received directing to pay Rs.11,000/- towards arrears and 11/01/2021 a further bill for Rs.12,248/-. Therefore on 08/02/21 they issued further notice for Rs.12,948/- and threatened to attach the property for the sum. Several bills with different amounts were issued to the complainant and same were illegal and baseless. Hence this complaint.
2) On receiving complaint, notice was properly sent to the opposite parties. Opposite parties not appeared before this Commission and called absent set ex-parte.
3) Complainant appeared before this Commission and filed proof affidavit in which he has affirmed and explained all the averments stated in the complaint in detail. He produced eight documents which are marked as Exts. A1 to A8. Ext. A1 is the Disconnection Advice dtd. 16/11/19 issued by opposite parties; Ext. A2 is the Demand and Disconnection notice dtd.10/07/20; Ext. A3 is the Demand and Disconnection notice dtd.14/09/20; Ext. A4 is the Demand and Disconnection notice dtd.18/11/20; Ext. A5 is the Disconnection Advice dtd. 06/01/21; Ext. A6 is the Demand & Disconnection notice dtd. 11/01/21; Ext. A7 is the Notice dtd. 08/02/21 issued by opposite parties and Ext. A8 is the Demand Notice dtd. 25/08/21.
4) We have gone through the contents of the proof affidavit as well as marked documents. Ext. A1 to A8 prove the case of the complainant. As there is no contra evidence available before us we are inclined to allow this complaint.
In the result, complaint is allowed and the notice dtd. 16/11/19 and bills dtd.10/07/20, 14/09/20, 18/11/20 and notice dtd. 06/01/21 and bill dtd. 11/01/21 and 08/02/21 for Rs.12,948/- is hereby cancelled herewith.
