Parties represented.  Heard the counsel.  Exts. A11 to A16 and B1 and B2 marked on consensus.  The counsel for the opposite party expressed their willingness to issue a fresh based on the meter reading in Ext. B1 meter reading diary and Ext. A11 test certificate.  The counsel for the complainant readily agreed the same.  The counsel for the complainant submitted that the complainant is not liable to pay any fine or interest since the opposite party had not issued the bills on the basis of meter reading.  Considering the facts and circumstances of the case we think that the complainant is not liable to pay any penal interest in this case.  Accordingly we direct the 2^nd opposite party to issue a fresh bill based on the meter reading in Ext. B1 and A11 for the disputed period.  The 2^nd opposite party is  also directed to adjust the amount if any remitted by the complainant.  The 2^nd opposite party shall issue the bill excluding the penal interest.  The order in I.A. 386/2009 will be in force till issue of the above bill.  In view of the above the proceedings in this complaint stand closed.
