1. This complaint filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. OP1 filed written version denying the allegations raised by the complainant. OP2 not filed written version and hence on 17/03/2016 OP2 was called absent and set exparte. The complainant filed affidavit on 23/05/2016. Subsequently as the complainant was continuously absent the evidence was closed on 15/02/2017 and subsequently complainant filed a reopen application and the same was allowed. After reopening the case complainant filed a fresh affidavit on 07/08/2017. Subsequent to that the complainant failed to appear before this commission to mark the documents. On 18/04/2022 the counsel appearing for the complainant reported no instruction and hence notice was issued to the complainant to appear before this commission on 07/06/2022. Subsequent to that the complainant appear before this commission on 06/07/2022. When the case came up for consideration today, it is found that the complainant is continuously absent and not turned up for marking documents, inspite of giving sufficient opportunities to the complainant. In the above circumstances, we find that the complainant is not interested to further proceed with this complaint. As the complainant failed to adduce any evidence to substantiate the case putfoward by the complainant against the opposite parties, we find that the complainant has miserably failed to substantiate his case and hence the complaint is to be dismissed for want of evidence.
In the result, the complaint is dismissed. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
