JUDGMENT

 

HON’BLE JUSTICE SRI.S.S. SATHEESACHANDRAN  : PRESIDENT

The above appeal has been filed by the complainant with a petition to condone delay of 672 days in filing the appeal.  Challenge in the appeal is against the quantum of compensation awarded by the forum.  Complainant has sought for compensation of Rs. 1,00,000/-, but the compensation awarded by the forum was only Rs. 25,000/- is the grievance in this appeal.  Concededly opposite parties have preferred an appeal against the very same Order challenging the grant of compensation by the forum and that appeal numbered as 376/2017 is pending on the file of this Commission.  It is seen present appellant/complainant appeared in that appeal long back.  Apparently complainant has no justifiable reason for condoning the inordinate delay in filing this appeal when he had taken notice of the appeal preferred by the opposite parties long back and was also heard on the applications moved in such appeal.  We find that the petition for condonation of delay lacks merit.  We also find that the challenges canvassed in the appeal to claim enhanced compensation than that was awarded by the forum is also not having any merit.  The delay condonation petition is dismissed and appeal is rejected.
