Padmini Sudheesh, President:<br /> <br /> The averments in the complaint are as follows: The complainant bought a bottle of Border Golden Brandy, 180 ML for Rs.54/- from the 2nd respondent on 12.11.07. The M.R.P. printed was Rs.49/- and the 2nd respondent charged more than the M.R.P. amount. The complainant questioned about it and was asked to seek remedy in a court of law. Hence notices were sent to the respondents on 12.11.2007. The notices were accepted but no positive response. Hence this complaint. <br /> <br /> 2. The respondents are called absent and declared exparte.<br /> <br /> 3. To prove the case complainant has filed affidavit and documents, which are marked as Exts. P1 to P4.<br /> <br /> 4. According to the complainant, he is entitled for refund of the excess amount and costs and compensation.<br /> <br /> 5. There is no evidence to the contrary.<br /> <br /> 6. In the result, complaint is allowed and the second respondent is directed to return the excess amount collected from the complainant and all the respondents are directed to pay Rs.500/- (Rupees five hundred only) towards costs to the complainant.
