This complaint filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. The opposite party entered appearance and filed written version denying the allegation of deficiency in service raised by the complainant against the opposite parties. When the case came up for consideration today, it is noticed that the complainant is continuously absent. A notice issued to the complainant to appear before this Commission was also seen accepted by the complainant. Even after accepting the notice the complainant failed to appear before this Commission to further proceed with the complaint. Though sufficient opportunities were granted to the complainant, the complainant failed to avail those opportunities to file affidavit and documents and adduce evidence to prove the case putforward by the complainant against the opposite parties. In view of the continuous absence of the complainant we find that the complainant is not interested to further proceed with this complaint. In the above circumstances we find that this is a fit case to be dismissed for default.
In the result, complaint is dismissed. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
