There is a delay of 109 days in filing of this appeal and to condone the same; an application (M.A. No. 337 of 2024) has been filed, which is supported by an affidavit. Application stands allowed for the reasons mentioned therein and delay of 109 days in filing of this appeal stands condoned. Accordingly, application stands disposed off.
Present appeal has been preferred against order dated 02.11.2023 passed by District Consumer Commission-Gurugram, vide which liability has been fastened upon appellant to pay compensation of Rs. 20,000/- on account of harassment pain and agony along with Rs.11,000/- as litigation charges. Along with appeal application (M.A. No. 338 of 2024) for interim relief/stay has also been filed. While urging for interim relief/stay learned counsel for the appellants has urged that: said direction are patently illegal. As per office report, Rs.16,183/- has been deposited by appellant, being the statutory amount required to be deposited while filing instant appeal. This Commission now directs appellant to deposit balance of amount, after deduction of statutory amount from the awarded amount, in terms of order dated 02.11.2023, before learned District Consumer Commission within four weeks from today. This amount, on being deposited would be released to complainant subject to complainant’s furnishing adequate surety to the satisfaction of learned District Consumer Commission.
Statutory amount of Rs.16,183/- will keep lying here during pendency of this appeal. Application for interim relief/stay stands disposed off in above terms.
Notice in main appeal be issued to respondent for 04.12.2024 through registered post.
