Notice in this appeal was issued to the respondents on 06.10.2017 and the matter was adjourned to 08.11.2017. Notices sent to respondents No.2 at 4^th address and respondent No.4 were received back unserved with the remarks “addressee not known”. However, notices sent to respondent No.2 at first three addresses and respondent No.3 were not received back. On the said date i.e. 08.11.2017, direction was issued to the Counsel for the appellant to supply fresh addresses of respondents No.2 & 4 within 10 days from that date and upon his doing so, notice was to be issued. The matter was adjourned to 22.12.2017, on which date, needful was not done. As per office report, notices could not be issued to respondents No.2 & 4 on account of non furnishing of their fresh addresses by the appellant. It was further reported by the office that report qua notice sent to respondent No.3 was not received. An undertaking was given by Counsel for the appellant to furnish correct addresses of respondents No.2 to 4 within 10 days from the said date and the matter was adjourned to 07.02.2018, on which date, the position remained the same. Correct addresses were not furnished, therefore, notice could not be issued. Again last opportunity was sought to do the needful. The matter was adjourned to 19.03.2018. In the meantime, another address of respondents No.2 to 4 was supplied. Notices issued again came back with the remarks “addressee not known”. Respondent No.3 was proceeded against exparte. Again time was sought to furnish correct addresses of respondents No.2 & 4 within 10 days from the said date and the matter was adjourned to 04.05.2018. Position remained the same. Nothing was done. The matter was adjourned to 16.05.2018, on which date, position remained the same and the matter was adjourned to 12.06.2018. On the said date i.e. 12.06.2018, again request was made to furnish correct addresses and the matter was adjourned to 05.07.2018. Nothing was done by the appellant to supply the correct addresses. The matter was adjourned to 16.07.2018 but even then fresh addresses were not furnished by the appellant and the matter was adjourned to today. Today, again as per report made by the office, nothing has been done by the appellant. For non-prosecution, this appeal stands dismissed.
