(In Person) Kavery Scales Service, Thadambattuthazham, } Opposite party Po.Karaparamba, Calicut.673010 (Expare) O R D E R SRI.K.T.SIDHIQ, PRESIDENT The complainant Shamsudheen advanced Rs.500/- for the purchase of one RV 20 Kg scale to opposite party on 13-09-2009 through their sales agent who visited the shop of the complainant. But as against the promise to deliver it on 22-09-2009 they neither delivered the weighing scale nor refunded the amount. Hence the complaint. 2. Notice to opposite party sent by registered post returned with postal endorsement ‘closed down’. But the complainant during enquiry has stated that the opposite party is still attending his telephone calls and the opposite party is still running the business. continuing. Hence it appears that opposite party has played some tactics with the postal authorities to return the notice. Therefore it is presumed that notice is served on opposite party and opposite party is set exparte. 3. Complainant adduced evidence as PW1. Ext.A1 marked. He deposed in tune with the complaint. Therefore the complaint is allowed and opposite party is directed to refund Rs.500/- received as advance from the complainant along with a cost of Rs.1500/-.
