The complainant has filed this Complaint u/s 12 of Consumer Protection Act, 1986 against the Opposite Parties (herein after referred in short as OPs) seeking direction to Ops to make payment of Rs.1,00,000/- with interest at 18% p.a. from the date of maturity of F.D. amount i.e. 05.09.2014 till realization, Rs.50,000/- towards mental agony and harassment, Rs.10,000/- towards the cost of this proceeding and any other relief as the Forum deems fit under the circumstances of the case.
2. The brief fact of the case are as follows:
The complainant is working as a Pigmy Agent. The OP is Cooperative Bank having financial transactions. The complainant to keep the deposited a sum of Rs.25,000/- in two receipts total in sum of Rs.50,000/- in-terms of Fixed Deposit being Account No.241 and 242 on 05.09.2008 and an its maturity date 05.09.2014. OP shall return sum of Rs.50,000/- each on deposit receipt and its total amount come to Rs.1,00,000/-. Further Ops have given an assured of good return of interest an above said deposit amount at rate of 11.73% p.a. Hence, as per the assurance, complainant deposit the total sum of Rs.50,000/-.
3. Unfortunately in the month of July-2014, complainant faces the financial crisis. On and oftenly complainant approached to Ops and requested to Ops to refund his F.D. amount, but OP has issued a letter dated: 21.07.2014 and stated that they will return F.D. amount only after maturity date, ultimately on 08.09.2014 and 20.09.2014 issued a legal notice through his advocate to the Ops, but they did not respond to it. In the course of time, the complainant was in need of money for which he making admission to his daughter, but he did not get any relief he has to suffered mental shock and agony. Therefore, Ops shall have to pay a F.D. amount of Rs.1,00,000/- with interest at 18% p.a. from the date of maturity of F.D. till realization. Rs.50,000/- towards mental agony and harassment and loss caused to complainant act Ops are squarely falls in the definitive of deficiency of service. Therefore, complainant has filed this present Complaint.
4. After receipt of notice, all Ops are appeared through their counsel. OP No.1 filed Objections and OP NO.2 adopts OP No.1’s Objection. Ops denied the allegation made by the complainant. According to the Ops, it is admitted that complainant is Pigmy Agent in Azad Cooperative Society and also admitted that complainant is a customer of OP-Bank, he has deposited of Rs.25,000/- in two receipt of total of Rs.50,000/- OP No.1 and 2 denied the allegation made by the complainant and stating in their Objection –

According to the case of OP, OP is Cooperative Bank registered under provision of Karnataka Cooperative Societies Act, 1959 vide its Order dated: 24.10.2013 liquidated the OP-Bank and appointed the liquidator for deposit of the assets and liabilities of the bank as per Law. I view of the same in the interest of equity to be dismissed.
5. OP No.3 filed Objection, it is contended that the contention taken in the Complaint are all false, fictitious and vexatious and the same are not tenable under the Law and facts.
That in the above case, OP No.3 Liquidator of the OP No.1-Society was impleaded as OP No.3.Now as per the Resolution dated: 26.06.2016, it was resolved to revive the said society. Accordingly DRCS, Bagalkot has ordered to revive the said society and cancelled the liquidation order dated: 06.08.2016. As per the said order, the functions and administration of the liquidator is ceased with effect from 06.08.2016. As such, the post of the liquidator is in existence now and hence for the Managing Committee of the said Society is responsible for the liabilities and obligations of the society.
6. The complainant tendered affidavit evidence and placed following documents marked at Annexure C1 to C8.

Ops filed affidavit evidence and filed 1 document and closed their side.
7. After considering the material placed on record, the following points that arise for our consideration are:-
- Whether the complainant made-out the grounds to allow the Complaint?
- What order?
8. Heard the arguments of counsel and perused the records.
9. Our findings on the above points are as under:

Point No.2:- As per the final order for following.

POINT NO.1 :- To substantiate this point, complainant tendered original F.D. receipts bearing No.241 and 242 amount of Rs.25,000/- in each receipt of total of Rs.50,000/- in terms of fixed deposit on 05.09.2008 and its maturity date is 05.09.2014. Ops shall return sum of Rs.50,000/- each on deposit receipt and its total amount come to Rs.1,00,000/-.
11. The defence of OP3, as per regulation dated: 26.06.2010 responded to revive the said Society. Accordingly, the Deputy Registrar of Cooperative Societies cancelled the liquidation. OP No.3 tender EX OP1 said Society Order dated: 16.08.2016. As per the said order, the function and administration of the liquidator of the society are ceased from the date of Order dated: 16.08.2016. Hence, the past of the Liquidator is not existence now. Therefore, Forum is discharge the liquidator from the liabilities and obligations.

Under the attending circumstances, the evidence which is placed before the Forum is marked at Annexure C1 to C8, there documents files the case of complainant, apart from the OP No.1 and 2 have not disputed this particular fact. It is proved beyond reasonable doubt, the OP NO.1 and 2 have taken Rs.50,000/- as deposited from the complainant assuring an interest at the rate of 11.73% p.a. as per EX C1 to C8 produced before this Forum. Hence, the complainant has proved deficiency in service on the part of OP NO.1 and 2. Hence, complainant has entitled to get deposited maturity amount of Rs.1,00,000/- with interest at 9% p.a. from the date of maturity of deposit amount i.e. from 05.09.2014 till its complete realization. The complainant is also entitled to Rs.2,000/- is awarded towards mental agony caused to the complainant. Rs.2,000/- towards cost of this litigation. Hence, we answer Point No.1 in the partly affirmative.
13. POINT NO.2 :- In view of our findings recorded to Point No.1, we proceed to pass the following;
:: ORDER ::
- The complaint is partly allowed.
- The OP No.1 and 2 shall have to pay an amount of Rs.1,00,000/- (Rupees one lakh) along with interest at the rate of 09% p.a. from the date of maturity i.e 05.09.2014, till the date of realization.
- The OP No.1 and 2 shall have to pay an amount of Rs.2,000/- (Rupees two thousand) towards mental agony and Rs.2,000/- (Rupees two thousand) towards cost of proceeding.
- The OP No.1 and 2 are directed to comply this order within a period of 60 days from the date of receipt of this order, failing which maturity amount of Rs.1,00,000/- carries interest at the rate of 12% p.a. from the date of order, till payment is made.
- Claim against OP No.3 is hereby dismissed.
