Complaint Under Section 12 of the Consumer Protection Act

ORDER.

                   Brief facts of the present complaint are that complainant is having trading & brooking account No.343197 with the Ops and to purchase shares, he gave a cheque No.258040 dated 28.02.2013 of Rs.5000/- of his Saving Bank Account No.033501000006299 with Indian Overseas Bank, Ambala Cantt. to the OPs  and the abovesaid cheque  was cleared by the complainant’s bank. It has been further alleged by the complainant that the Ops failed to credit the said amount to complainant’s brooking account No.343197 and on enquiry, he found that the same has been credited to  the brooking account no.343160 of his wife  without any written consent of the complainant. However, despite written/verbal requests, the Ops failed to rectify their willful error. In this regard, a legal notice dated 24.04.2013 was served upon the Ops but they failed to respond.  The complainant also sent a complaint to National Stock Exchange of India  and SEBI, Mumbai in this regard but no result. Thus the complainant alleged that  the Ops are deficient in providing proper services to him and prayed for issuing a direction to Ops as mentioned in the prayer clause of complaint.

2.                Registered notices were sent to the Ops but they failed to appear and were proceeded against exparte vide order dated 18.03.2014.

3.                To prove his case, complainant tendered his affidavit as Annexure CX alongwith documents as Annexures C-1 to C-15 and closed the evidence.

4.                We have heard the complainant and gone through the record very carefully. The main grievance of the complainant is that the amount of Rs.5000/- so given by him to the Ops through cheque for purchase of shares not credited by them to his Brooking Account No.343197 rather it was credited to his wife’s Brooking Account No.343160 by the Ops which is admittedly a deficiency in service on the part of Ops.

 5.               At the very outset, from the perusal of documents Annexure C-1 & C-2, it is clear that an amount of Rs.5000/- has been withdrawn from the Saving Bank Account of the complainant on 04.03.2013 and has been credited to the Ops.  But the Ops  i.e. Karvy Stock have credited  the said amount of Rs.5000/- in the Brooking Account No.343160 of complainant’s wife on 08.03.2013 as depicted in the document Annexure C-14 which is an account statement pertaining to complainant’s wife Brooking Account with Ops.  But the  complainant has failed to produce any document on file wherefrom it is proved that he submitted the cheque of Rs.5000/- to Ops for crediting the said amount only in his brooking account No.343197 and not in the brooking account No.343160 of his wife. As such, we have no hesitation in holding that the complainant has miserably failed to prove his version and thus the present complaint is hereby dismissed with no order as to costs.  Copies of this order be sent to the parties concerned free of costs, as per rules. File be consigned to the record room after due compliance.
