SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  After admitting the complaint notice was issued to the opposite party.  Though the opposite party accepted the notice, failed to appear before this Commission on the date fixed for his appearance and on the subsequent posting date.  Hence the opposite party was called absent on 01/12/2021 and declared ex parte.  Subcequently, sufficient opportunity were given to the complainant to adduce evidence by filing affidavit.  Inspite of giving sufficient opportunities, the complainant failed to file an affidavit or mark the documents.  As such there is no evidence from the side of the complainant to establish the case of the complainant.  In view of the continuous absence of the complainant and the failure to adduce evidence, we find that the complainant miserably failed to substantiate his case put forward against the opposite party.    

In the result the complaint is dismissed.  There will be no order as to cost. 

 

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
