Today is fixed for ex-parte hearing. But the Complainant is found absent on call. The record shows that 18.07.23 and 03.10.23 were fixed for ex-parte hearing but the Complainant was found absent on those days. The record shows that the Complainant has not filed evidence till today. 

         The Complainant filed the case praying for passing an order directing the OP to replace the AC machine with a new one. But the record shows that the Complainant is not at all interested in this case as he did not appear on dates fixed for ex-parte hearing. The conduct of the Complainant indicates that he has no sufficient evidence to establish his case and as such the instant case is liable to be dismissed ex-parte.

Hence, it is

Ordered

That the complaint Case No. CC/137/2019 be and the same is dismissed ex-parte against the OPs but under the circumstances without any order as to costs.

Let plain copy of this order  be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand  /by post under proper acknowledgment  as per rules, for information and necessary action.
