ORDER

 This is an application for recall of non-bailable warrants issued against the OP No.2 in execution application No.145 of 2017 for non compliance of order.  

                        The counsel for the applicant states that the OP No.2 has already handed over a cheque of Rs.3000/- to the complainant, duly received by him , which is annexed with the application as proof thereof.  He therefore, requested for recalling of the non-bailable warrants issued against the OP No.2.

                         In view of the  photo copy of cheque placed on record amounting to Rs.3000/-  and duly received by the complainant,  the  registry is directed to recall back the non-bailable warrants if any issued against the OP No.2 only immediately.  However, the liability of the OP No.2 is not discharged till the order under execution is fully complied with by the OPs.

                        The application is disposed of accordingly.

                        This file be tagged with the main file.

                        Certified copy be sent to the parties free of charge. After compliance file be consigned.
