ORAL JUDGMENT PER JUSTICE HON’BLE MR. J.M. MALIK 1. Counsel for the petitioner present. Respondent Sh. Karamjit Singh is present in person. He submits that he will argue the case of his own accord. Arguments heard. 2. The respondent/complainant had applied for tube-well connection on 01.02.1990 but he has not got the tube- well connection till now i.e. after the elapse of 22 years. He had paid Rs. 9,480/- for tube-well connection in the year 2004. The Govt. further asked him to deposit loading charges in the sum of Rs. 14,400/- in the month of November, 2008. It is difficult to fathom why did Govt. charge the loading charges in the sum of Rs. 14,400/- when they are unable to install the tube-well connection. Today, the counsel for the petitioner has filed a letter given by the Sr. Executive Engineer. The contents of the letter are reproduced as under:- “Respected Sir, As per directions of the Hon’ble National Commission Vide order dated 27.-7-2012, it is submitted that cheque no. 126927 dated 14.-8-12 for Rs. 10000/- was handed over to Sh. Karamjit Singh (Respondent) in District Consumer Forum, Ludhiana on 21-8-12. In the year 2011-12, 30 no. tubewell connections were released to general category applicants. So keeping in view the progress of release of tubewell connections in the previous year i.e.. 2011-12 and Seniority of Sh. Karamjit Singh (23rd) it will take another 9 to 10 months to release tubewell connection to Sh. Karamjit Singh provided that the supply of material remains the same as it was in the previous years. The counsel for the petitioner submits that the original number of the respondent was 85 which has now come down to 23 and within 10 or 12 months, the tube-well connection will be given to him. He further submits that due to power shortage in the State and due to increase in the population the needful could not be done earlier. He explained that as per State Commission’s order they have already paid Rs. 25,000/- to the respondent and Rs. 10,000/- litigation charges as per this Commission order. 4. In view of the undertaking given by Sh. Chetan Kumar, Sr. Executive Engineer, it is ordered that tubewell connection must be given to the respondent within 12 months otherwise the order of the State Commission will prevail. This is made clear that vide this order no special concession to be given to the respondent. He must get the tube-well connection as per the seniority list. 5. The revision petition stands disposed of. 6. Order be given dasti also. |
