O R D E R

 

NAWAB SINGH J, (ORAL)

 

IDM INFOCOMM-opposite party has challenged the correctness and legality of the order dated October 07th, 2015, passed by District Consumer Disputes Redressal Forum, Ambala (for short ‘District Forum’) whereby complaint filed by Karam Singh was allowed. Operative part of the order is reproduced as under:-

“(i)     to return Rs.18,200/- i.e. cost of the mobile set to the complainant alongwith simple interest @ 9% per annum from the date of its purchase to till its realization

(ii)      to pay Rs.3000/- as compensation for harassment and mental agony etc.

(iii)     also to pay Rs.2000/- as cost of litigation..”

2.      During the course of arguments, Manish Malhotra, Manager on behalf of the appellant has made the following statement (Annexure A-1):-

          “I am ready to pay Rs.20,000/- in full and final settlement to Karam Singh-complainant. I have already deposited Rs.12,500/- as statutory amount with this Commission at the time of filing the present appeal and same may be adjusted towards the amount of Rs.20,000/- and I shall pay the remaining amount of Rs.7500/- on the next date of hearing.”

3.      The proposal given by the appellant has been accepted by the learned counsel for the complainant.  Learned counsel for the complainant has received cheque of Rs.7500/- (photocopy Annexure A-2) from the appellant.

4.      In view of above, the appeal is disposed of accordingly.

5.      The statutory amount of Rs.12,500/- deposited at the time of filing the appeal be refunded to the complainant against proper receipt and identification in accordance with rules, after the expiry of period of appeal/revision, if any.
