BY THE STATE COMMISSION ( PER HON'BLE MRS. JUSTICE NISHA GUPTA,PRESIDENT):

 

This appeal has been preferred against the order dated 6.7.2015 of the District Consumer Forum, Jaipur 3^rd whereby compensation has been allowed to the respondent.

 

The contention of the appellant is that telephone connection of the respondent was remained unserviceable from 3.10.2009 to 28.10.2009 but it was negligence on the part of PWD/JDA and there is no deficiency of service on their part.

 

Per contra the contention of the respondent is that there is no infirmity in the impugned order and no interference is needed.

 

Heard the learned counsel for the parties and perused the impugned judgment as well as the original record of the case.

 

There is no dispute about the fact that telephone connection of the complainant remained unserviceable from 3.10.2009 to 28.10.2009. Now the appellant wants to fix the liability on PWD/JDA but no evidence to this effect has been

submitted before the Forum below hence, the Forum below has rightly held that it was deficiency of service on the part of the appellant and suitable compensation is awarded and no interference is needed in the impugned order passed by the Forum below. The appeal is dismissed in limine.
