O R D E R

1. Complainant’s pleading is that he bought a toffee from the 2^nd OP’s store for Re.1/-.  But there was no toffee inside and it contained only air.  He seeks a compensation of Rs.2 lakhs and expense of Rs.2,000/-.
2. Upon receipt of notice, the OPs entered appearance and OP1 filed version denying their liability.
3. Even though version was filed denying their liability, OP1 submitted that they were ready and willing to settle the matter. They even offered Rs.250/- to the complainant in the open court. But the complainant vehemently opposed this deal and wanted his compensation of Rs.2 lakhs.
4. Since the OP has admitted that there was genuineness in the claim of the complainant and expressed their readiness and willingness to settle the matter, a dispute as contemplated under Section 38 (2) (b) does not arise.  
5. Therefore, we dispose off this complaint with a direction to OP1 to pay the complainant Rs.300/- within 45 days of receipt of this order. If the first OP has not complied with this Order, they shall be liable to pay Rs.500/- per month or part thereof by way of solatium from the date of this Order till the date of final payment.
