Complainant filed the present complaint under Section 12 of the Consumer Protection Act, 1986 as amended upto date against opposite parties to claim damages of Rs.5,00,000/- on account of deficiency and defective service in massonary work in his newly constructed School building and further compensation for causing mental agony and physical harassment alongwith cost of litigation. Opposite parties appeared and filed written statement. Both the parties led evidence in support of their respective pleas. <br /> In the ultimate analysis of aforesaid discussion, we accept the complaint and award Rs.3,20,000/- as estimated cost of los due to faulty construction and deficiency in quality of work against opposite party No.2 and monetary compensation of Rs.20,000/- for mental agony and physical harassment besides costs of litigation of Rs.1000/- which would be paid by opposite party No.2 within a period of one month from the receipt of copy of the order.
