          Learned counsel for the appellant has given two cheques to the learned counsel for complainant issued in the name of Kailash Kumari and her son Pankaj Kumar and these cheques are received by learned counsel for complainant, keeping in view the order dated 12.01.2017. In this way impugned order dated 05.02.2014 be deemed as set aside as per order dated 12.01.2017. Parties are directed to appear before District Forum on 14.02.2017 for further proceedings as per order dated 12.01.2017.

12.    Statutory amount of Rs.1,000/- deposited at the time of filing the appeal be refunded to the appellant against proper receipt and identification in accordance with rules, after the expiry of period of appeal and revision, if any filed in this case.
