ORDER

M.A. No.   1156/2011 (FOR RELEASE OF THE AMOUNT)

 

        This revision petition was dismissed by this Commission on 12.12.2008. Petitioner has moved this application stating therein that the respondent had withdrawn the sum of Rs.1,50,000/- deposited by the petitioner before the State Commission during the pendency of the appeal. Remaining sum of Rs.1,38,885/- was paid to the respondent in terms of the order dated 20.3.2009 passed by the District Forum in Execution Petition. State Commission had closed the execution proceedings by order dated 18.3.2010 and by observing thus :
“But it is pertinent to note that there is no mention of maturity value of Rs.2,50,983/- in the final order passed by the District Forum is a direction to the O P to refund Rs.2,00.000/- along with interest at 11 1/1% P.a. from 10.07.2000 till payment. If that is so, the Distirct Forum is not right in calculation interest on the maturity value of Rs.2,50,983/- from 10.07.2000 till the date of filling the Execution Petition.
As per the memo of calculation filed by the JDR, a sum of Rs.1,38,885/- as an amount payable to the DHR apart from the amount of Rs.1,50,000/- already paid on 26.02.2002, Since the JDR has paid this admitted amount as per the order dated 20.03.2009 and satisfied the award, this execution petition is liable to be closed.”
 
        According to the petitioner bank, decree has been satisfied; that the petitioner bank is entitled to refund of Rs.77,175/- deposited by it in this Commission along with accrued interest. 
        Against the order dated 18.3.2010, respondent/complainant had filed R.P. No.1273/2011 with a delay of 299 days. By an order of even date, we have dismissed the R.P. No.1273/2011 on the ground of delay as well as on merits.
        Petitioner has paid the entire decretal amount to the respondent. No amount is due from the petitioner to the respondent. Office is directed to refund the sum of Rs.77,175/- deposited by the petitioner along with accrued interest thereon up-to-date.
