            The appellant is the opposite party in OP.17704 in the file of CDRF, Thiruvananthapuram. The appellant is under orders to pay a sum of Rs.10,000/- as compensation and Rs.1,000/- as costs and interest at the rate of 12% the amount is not paid within 2 months.
          2. The case of the complainant is that he availed a loan of Rs.14,000/- in the year 1998 after depositing his title deed of 3 cents of landed property and building. The complainant is engaged hiring amplifier and mike sets. He closed the loan in the year 2001. But, the opposite party did not return the title deed, tax receipt, possession certificate, encumbrance certificate and location certificate.    Hence he could sell the property for his urgent needs. He has sought for a compensation of Rs.50,000/- and cost of Rs.2,000/-.
          3. It is the case of the opposite party/appellant that for realization of the loan amount they had to institute OS.No.7/1993 at the Munsiff Court, Attingal. The loan transaction was closed on 31.01.2001 as per one time settlement. The appellant could get back the documents from the Court only on 29.5.04. Opposite party has intimated the complainant as to the receipt of the documents but they did not receive back the documents. Opposite parties submitted the documents before the Forum on 15.6.04.
          4. The evidence adduced consisted of the testimony of PW1 Exts.P1 to P4 and D1 to D3.
          We find that there is a delay of 3 ½ years since the date of closing the loan and producing   the   documents before the Forum. We find that there is no patent illegality in the order of the Forum. Hence the appeal is dismissed.
