JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT

The appellants are the opposite parties in OP.164/04 in the file of CDRF, Thiruvananthapuram. The appellants are under orders to pay a sum of Rs.69400/- with interest at 12% per annum and also to pay a sum of Rs.2000/- as costs.
It is the case of the complainant that he obtained four Airline tickets for journey from Trivandrum to Calgery (Canada) to and fro ie., two adult and two children.   One return adult ticket and two tickets of the miners were returned. The refund of Rs.1 lakh the fare is sought.
The first opposite parties/appellants (airlines) has stated that a sum of Rs.200350/- was received towards two adults and two children return ticket at the rate of 59450/- per ticket for adult and Rs.40725/- per ticket as children fare. It is also mentioned that the one-way ticket from Trivandrum to Calgary for an adult was Rs.33700/- and for child Rs.25390/-.   According to them after deducting one way adult   fare of Rs.33700/- and one way child fare of Rs.25390/- the balance ie., Rs.50500/-was offered to be returned. It is also pointed out that international fares   change from time to time and that one-way ticket will cost more and two way ticket will be charged less for the one-way journey.
We find that in the absence of any contra-evidence from the appellant the Forum has rightly ordered to return the price of one adult fare and 2 children fare after deducting the service charge of Rs.1500/-. We find that there is no illegality in the order.   There is no scope for interferes.
In the result, the appeal is dismissed.
