By Smt. Padmini Sudheesh, President: The petitioners case is that he was a kuri subscriber of respondent company and he had remitted towards the kuri Rs.500/- each for 21 instalments. It was also recorded in the kuri passbook. The respondent had borrowed Rs.25,000/- from the complainant and not returned. Towards the amount he had issued a cheque to the complainant and the cheque was dishonoured and criminal complaint is pending before the Judicial First Class Magistrate Court No.1, Thrissur. Hence the petitioner has lost faith in the respondent, he did not remit the kuri amount from 5.1.01. The total amount remitted in the kuri was Rs.10,500/-. The kuri terminated on 5.2.04, but the amount and interest not returned. Lawyer notice sent, no reply, no remedy. Hence this complaint. 2. The respondent set exparte. 3. To prove the case, complainant has filed affidavit and six documents. The documents are marked as Exts. P1 to P6. 4. According to the petitioner, he is entitled for the remitted amount and interest. 5. There is no evidence to the contrary. 6. So the complaint is allowed and the respondent is directed to return the amount of Rs.10,500/- (Rupees ten thousand and five hundred only) to the complainant with interest at the rate of 12% for each instalment. The respondent is further directed to pay Rs.1000/- (Rupees one thousand only) as costs to the complainant. Comply the order within one month.
