          The appellants are the opposite parties/dealer of T.V. sets in C.C. 218/10 in the file of CDRF, Kottayam was absent before the Forum.  The appellants are under orders to pay a sum of Rs. 3,000/- or a brand new DVD (sic.DVD Player) and compensation of Rs. 1,500/- and cost of Rs. 500/- with interest at 9%, if the amount is not paid within one month. 

 

          The evidence adduced consisted of the testimony of Pw1 and Ext. A1, invoice.

 The matter is with respect to the failure to honour the commitment to supply a DVD player along with the purchase of T.V.  There is no reason as to why the opposite party/appellant were  ex-parties before the Forum.   On a perusal of the order to the Forum, we find that there is no patent illegality as the evidence of the complainant has not been contradicted.   Hence there is no scope for admitting the appeal.   In the result the appeal is dismissed in limine.
