The case of the complainant:


 

The opposite party, proprietor of Krupa Marriage Bureau and Job Centre, approached the complainant and accepted Rs.6,500/- as registration fee for the marriage purpose of the complainant. At the time of giving the amount the opposite party assured that the marriage of the complainant will be held within a month. Opposite party also assured the complainant If it is not held the amount will be refunded by the opposite party. When there is no response from the opposite party the complainant visited the opposite party's establishment and again paid an amount of Rs.3,500/-. But it is not written in the receipt. Earlier the opposite party informed the complainant over phone that the registration fee is Rs.1000/- only. When the complainant enquired about the matter the opposite party threatened the complainant saying that his brother is holding the post of Sub Inspector in Police. Even though seven months passed there is no response from the opposite party. So the complainant suffered much mental agony and financial loss.

So the complainant seeking an order directing the opposite party to refund the amount of Rs.10,000/- and pay an amount of Rs.10,000/- as compensation for mental agony.

Opposite party did not appear before the Forum though notice was served and set exparte.

Complainant filed proof affidavit and Ext. A1 and A2 marked.

Issues to be considered are

      1. Whether there is any deficiency of service on the part of opposite party?

      2. If so, what is the relief and cost?

Issues No. I&2

The complainant has paid an amount of Rs.10,000/- to the opposite party for the marriage purpose of the complainant himself. At the time of paying the amount the opposite party made the complainant believe that the marriage will be held within a month and if it is not held the amount will be refunded. When there is no response from the opposite party the complainant enquired about the matter. But the opposite party threatened the complainant by saying that his brother is holding a higher post in the Police Department. It is evident from Ext.A2 document that the complainant has paid Rs.4,000/- to the opposite party. But the complainant says that he has paid Rs.10,000/- in total. When the complainant approached the opposite party to enquire the progress of the matter, he has paid the balance amount also. But the opposite party did not endorse the payment in the receipt. As opposite party remains exparte, the contention of the complainant stand unchallenged. After accepting this much of money the opposite party did not take any steps to fulfill the purpose of the complainant.

From the above discussions we are of the view that there is unfair trade practice on the part of opposite party.

In the result complaint allowed. Opposite party is directed to refund an amount of Rs.10,000/- (Rupees Ten thousand only) and pay an amount of Rs.5,000/- (Rupees Five thousand only) as compensation and 1000/- (Rupees One thousand only) as cost of the proceedings to the complainant.

Order shall be complied within one month from the date of receipt of order failing which the whole amount shall carry 9% interest per annum from the date of order till realization.

Pronounced in the open court on this the 26th day of September, 2012.
