Complainant No.1 and his counsel present and files Application under section 151 of CPC seeking permit him to withdraw the present complaint with a liberty to approach appropriate Forum.  In the verifying Affidavit filed by complainant No.1 in support of the said I.A. it is stated that, subsequent to filing of the instance complaint, temporary commercial electricity connection given was permanently cut-off due to expiry of its permit and complainant was forced to approach Hon’ble High Court of Karnataka under W.P. No.9853/2021, wherein the complainant made aware of various other mishaps, illegalities and malpractices made by the OP including providing him a fake building plan for loan verification purposes.  These facts discovered subsequent to filing of the present complaint which caused substantial and permanent damage to the property value, as well as a continuous mental agony to the complainant.  In view of the same complainant advised to withdraw the present complaint with a liberty to approach an appropriate Forum with cumulative facts and documents on record to adjudicate the instant consumer dispute in the interest of justice and equity.  The balance of convenience is in favour of complainant in the present circumstances of the case.  Hence prays to permit the complainant to withdraw instant consumer complaint with a liberty to re-file the same before the appropriate forum. 

In view of the above submission made by the complainant in the affidavit filed in support of the said I.A. the complaint is disposed off as withdrawn with a liberty to the complainant to approach before the appropriate Forum.
