SMT. N. SHAJITHA BEEVI (MEMBER)<br /> <br /> The complainant Sri. Satheesan M.S. filed this complaint before this Forum alleging deficiency in service on the part of the opposite party. The grievance of the complainant is that as per the information furnished by the opposite party to the complainant, the complainant obtained the certain machinery item for the manufacturing chalk and paid amounts to the opposite party. For the insufficiency of the raw material, the complainant stopped the business and demanded back the amount from the opposite party, after entrusting the machinery items. Since the matter is relating the settlement of amount between the complaint and opposite party, it cannot be say that the complainant is a consumer u/s 2(1) d of the Consumer Protection Act.<br /> Hence this complaint is not maintainable and dismissed.
