ORDER

Vide impugned order, the appeal filed by the petitioner before the State Commission was dismissed in default. It is stated by the learned counsel for the respondent that there is no objection if the impugned order passed by the State Commission is set aside and the matter is remanded back to State Commission to decide the matter afresh after giving due opportunities to both the parties. In view of the statement made by the learned counsel for the respondent, the impugned order passed by the State Commission is set aside and the matter is remanded to the State Commission, subject to payment of cost of Rs.20,000/-. Cost be paid to the respondent directly by way of demand draft within four weeks. In case the petitioner fails to pay the cost the within the specified period, the revision petition shall stand dismissed automatically without any further orders. Consequently, we remand the matter to the State Commission for deciding the matter afresh after giving due opportunities to both the parties. The State Commission shall make an endeavour to decide the matter preferably within a period of one year from the date of receipt of this order. Parties are directed to appear before the State Commission on 25th February 2014. With these observations, the revision petition stand disposed of.
