It is seen from the records that appellants were set exparte by the Forum. Taking in to account the nature of the contentions raised by the parties. We feel that an opportunity should be given to the appellant to

contest the matter on merits. Appellant to pay cost of Rs. 5000/- to the complainant.
In the result appeal is allowed. The impugned order of the Forum allowing the complaint is set aside. The matter is remanded to the Forum for fresh disposal in accordance with law. Appellant shall appear before the Forum on 31/03/2017. He is permitted to cost before the Forum. On receipt of the copy of this order Forum shall issue notice to the complaint.
