Heard the counsel for the complainant regarding admission of this complaint.   The complainant has presented this complaint against the Op with an allegation that he had paid Rs.11,030/- to the Op for availing service of Op to provide Info Network information for his business purpose but the Op after receipt of money has failed to provide service and therefore has sought for a direction to the Op to refund his money.

        Counsel for the complainant admits that the complainant is a business man is carrying on business of real estate as an agency.  He has also not disputed that the complainant intended to avail the service of Op for its business activity.    As per the definition of the consumer as defined under the consumer protection act “any service availed for commercial purpose is excluded from the purview of the act”.  Therefore, when the complainant intended to avail service of the Op for boosting his real estate business, he cannot be construed as a consumer.  Hence, complaint is not maintainable, therefore is dismissed at the stage of admission.  However, complainant is at liberty to approach civil court for his relief.
