Final Order / Judgement

Order No. 31 dtd.28.08.19

                                Learned Counsel for the parties filed hazira. Herrd the argument, perused the documents. It is the case of the complainant that he is a domestic category of consumer under Ops bearing Consumer No.01054033. It is also submitted by the complainant that Ops are serving an illegal and erroneous billing without taking the actual meter reading and prayed this forum for revision of arrear outstanding. On the otherhand, the defense plea of the complainant is that an arrear outstanding of Rs.36,585.19 is pending on the complainant till March,2019 and Ops are ready and willing to consider the grievance of the complainant within the provision of O.E.R.C.

                   Considering the submission and on perusal of the billing statement of the complainant-consumer it appears that  the monthly energy bills of the complainant from 6/2016 to 4/2017 are prepared on average consumption basis also the monthly energy bills from Feb.2014 to June,2014 are also prepared an average consumption basis as the premises of the complainant was under lock and key. In the circumstances, we are of the opinion that when the Ops are ready to revised bill of the complainant no further discussion is required for the purpose.                  

                   Having observation reflected above it is directed that Ops will revise the bill of the complainant as per our aforesaid observation under the provisions of law on receipt of the revision application of the complainant. The order is to be carried out by the Ops within one month of receipt of the revision application of the complainant, failing which action be initiated against the Ops under the provisions of C.P.Act,1986. It is further directed that, Ops shall not take any coercive action against the complainant till completion of the process.

                            Complaint is allowed in part without cost.
